Distribution of 2nd pillar assets: The distribution of 2nd pillar assets accumulated during marriage is mandatory, regardless of the matrimonial property regime chosen (including separation as to property). This means that even if a couple has signed a marriage contract stipulating a separation of property regime, 2nd pillar assets must be divided equally.
In some cases, the division of BVG assets can replace all or part of the maintenance contribution due after the divorce.
The principle of balancing pension assets also applies if one of the spouses is already receiving BVG/LPP benefits for disability or retirement, in accordance with Articles 124 and 124a of the Swiss Civil Code.
These principles are designed to ensure a degree of fairness between spouses on marriage dissolution, taking into account their respective contributions to retirement provision and personal circumstances.
Abandonment of the marital home is no longer grounds for divorce in Switzerland. For more than 10 years, any notion of fault has been ruled out as irrelevant when deciding on divorce or separation and their consequences.
