Search following evidence of illegal gambling

According to a press release issued by the Swiss Federal Gambling Board (SFGB) on November 4, 2024, the SFGB, in collaboration with the Zurich Cantonal Police and the Winterthur Local Police, searched a premises in Winterthur following indications that the establishment was operating illegal table games and online casino games without a license.

More than 20 people were in the premises, sitting at several tables and playing cards. The SFGB seized a gambling device on which it was probably possible to play online casino games. The SFGB also seized cash worth over CHF 1’000.-, cell phones and a tablet.

The SFGB has indicated that it will evaluate the objects and the statements made by the individuals. It pointed out that the person charged faces a penalty for violating the Gambling Act. Anyone who operates, organizes or makes available casino games without holding the necessary licences risks a custodial sentence of up to five years or a fine of up to 180 days.

In its press release, the SFGB also pointed out that, unlike in other countries such as Germany, players who take part in unauthorized gambling in Switzerland are not liable to prosecution. However, any bets and winnings can be seized as part of criminal proceedings against the operator of the unauthorized offer. In Germany, participants in unauthorized gambling may face a custodial sentence of up to 6 months or a fine of up to 180 days (§ 285 German Criminal Code).
